Description of an administrative service

Administrative procedure implies mandatory actions taken by the Central Prison Hospital (hereinafter referred to as Hospital, institution) while examining a complaint or notification against actions, failure to act or administrative decisions taken by Hospital that might have violated rights and legitimate interests of a person referred to in a complaint or notification and taking decision on the administrative procedure on that account.

Personal complaints or notifications shall be submitted in written only (personally applying to Hospital, by mail or via a courier).

The decision of an administrative procedure shall be prepared in two copies one to be delivered or sent by post to a person concerned the other one to be stored in Hospital in compliance with the procedure established in legislation.

The decision of an administrative procedure shall be delivered to person upon his/her arrival to Hospital or sent by post.

Information and other documentation to be submitted by a person

A complaint or notification of an individual.

A complaint or notification of an individual should be signed, name, surname, place of residence (provided a natural entity is applying) or name, code and registered office (provided a legal entity is applying) and contact details should be indicated.

Should a person‘s representative apply to Hospital on behalf of a person represented he/she should indicate in a complaint or notification his/her name, surname, place of residence as well as name, surname, place of residence of a person represented (provided an application is on behalf of a natural entity) or name, code and registered office (an application is on behalf of a legal entity) and attach an authorization for representation.

Should a complaint be submitted to Hospital by a person‘s representative whose authorization for representation is issued in another country, the above mentioned document should be legalized in compliance with the procedure established in Description of the Procedure for Document Legalization and Confirmation for Approval Certificate (Apostille) approved by the Resolution No. 1079 of 20 October 2006 of the Government of the Republic of Lithuania (Official Gazette, 2006, No. 118-4477).

Information and other documentation to be submitted o the institution (an employee examining an application)

In consideration of the content of a complaint or notification an employee examining a complaint or notification receives information and documents necessary for making the decision of an administrative procedure from Hospital administrative units and other institutions or agencies in compliance with the procedure established in legislation.

In consideration of the content of a complaint or notification as well as assignment (resolution) of Hospital Director or Deputy Director the appropriate Hospital administrative units provide administrative service within the scope of their competences.

Duration of provision of an administrative procedure

An administrative procedure should be completed and the decision made within 20 working days since its launch. Provided an administrative procedure fails to be completed within the indicated period due to objective reasons the duration thereof shall be extended but no more than for 10 working days.

The service is provided free of charge.

Form of complaint, sample of filling it and content of an application

A complaint or notification shall be submitted in free form.

A complaint or notification of an individual should be signed, name, surname, place of residence (provided a natural entity is applying) or name, code and registered office (provided a legal entity is applying) and contact details should be indicated.

Peculiarities of provision of an administrative procedure

A complaint or notification without indication of a person’s name, surname, place of residence or registered office and not signed may not be examined upon a decision taken by Hospital Director or Deputy Director. The decision on withholding to examine a complaint or notification shall be communicated to a person not later than within 5 working days since receipt of a complaint or notification except when no personal contact details were indicated in a complaint or notification.

Should Hospital be not authorized to make a decision of administrative procedure for a complaint or notification, not later than within 5 working days it shall be transferred to an authorized public administration entity informing a person thereof.

Should it appear that the court has started examining the same complaint for which the administrative procedure has been launched the administrative procedure is suspended until the court adjudges a complaint informing a person thereof.

A complaint shall not be examined provided Hospital or court has already made a decision of an administrative procedure on the same matter and a person fails to provide new factual data for the decision to be argued against, as well as in cases when over 6 months have passed from the day of reveal of violations indicated in a complaint before the day of submitting a complaint. A person shall be informed about a decision not to examine a complaint within 5 working days since receipt of a complaint.

Should a person‘s application not be examined the decision of administrative procedure shall be made after interviewing a person referred to in a notification whose rights and legitimate interests might have been violated.

A person against whom an administrative procedure is launched shall be informed in written no later than within 3 working days about an adopted decision of administrative procedure and factual circumstances disclosed in the process of examination of a complaint as well as legal acts in compliance with which a decision of administrative procedure was made and the procedure of appealing against a decision.

Description of an administrative service

Natural and legal entities who need data on received income, seniority or other juridical facts from documentation on operational activities of the Central Prison Hospital (hereinafter referred to as Hospital, institution) may apply for the service.

Whereas the information provided contains personal data a person applying must present a document proving his/her identity (natural entities) or other data proving the right to receive information (legal entities).

Information and other documentation to be submitted by a person

1. Request.

2. A document proving personal identity.

Personal requests/applications shall be as follows:

1. written in state language (this provision shall not be applied to requests/applications sent by post);

2. written readably;

3. signed by an applicant, name, surname, place of residence (provided a natural entity is applying) or name, code and registered office (provided a legal entity is applying) and contact details should be indicated.

Should a person‘s request/application be submitted to Hospital by a person‘s representative, he/she should provide authorization for representation and person’s request/application which complies with the requirements established in items 1-3.

Should a person‘s representative apply to Hospital on behalf of a person represented he/she should indicate in a request/application his/her name, surname, place of residence as well as name, surname, place of residence of a person represented (provided a request/application is on behalf of a natural entity) or name, code and registered office (provided a request/application is on behalf of a legal entity) and attach an authorization for representation.

Should a request/application be submitted to Hospital by a person‘s representative whose authorization for representation is issued in another country, the above mentioned document should be legalized in compliance with the procedure established in Description of the Procedure for Document Legalization and Confirmation for Approval Certificate (Apostille) approved by the Resolution No. 1079 of 20 October 2006 of the Government of the Republic of Lithuania (Official Gazette, 2006, No. 118-4477).

A person having provided a document proving personal identity or having otherwise confirmed his/her identity in compliance with the procedure established in the legislation of the Republic of Lithuania shall have the right to get information about him/herself except in cases established in the legislation of the Republic of Lithuania when this information is not provided. Should a request for provision of personal information be sent by post or via a courier a notarized or otherwise validated in compliance with the procedure established in the legislation of the Republic of Lithuania copy of a document proving personal identity should be attached to it. Should a person‘s representative apply for the information on a person he/she should provide an authorization for representation and a document proving personal identity or otherwise confirm his/her identity in compliance with the procedure established in the legislation of the Republic of Lithuania.

The institution having found the information presented in a request/application was incomplete or inaccurate shall address an applicant within 5 working days since receipt of the information with the request to specify the information.

In consideration of the content of a request/application as well as assignment (resolution) of Hospital Director or Deputy Director the appropriate Hospital administrative units provide an administrative service within the scope of their competences.

Duration of provision of an administrative procedure

Within 20 working days (in consideration of the amount and complexity of the requested information the duration shall be extended but no more than for 20 working days).

Cost of provision of an administrative procedure

The information on the activities of the institution in implementation of the functions assigned by legislation is provided free of charge.

For official purposes (to state institutions and other agencies established in the Order No. 65 on Approval of the Procedure for Provision of Information about a Patient to State Institutions and Other Agencies of 1 February 2001 of the Minister of Health of the Republic of Lithuania (Official Gazette, 2001, No. 13-405) the information on a patient is provided free of charge.

A patient or patient’s representative having submitted a request/application in compliance with the procedure established in legislation to Hospital with request to prepare and issue copies of a patient’s medical documents endorsed by the institution this service shall be provided after receipt of advance payment for preparation of document copies in compliance with the Procedure on Remuneration for Preparation of Document Copies approved by the Resolution No. 1039 of 1 September 2000 of the Government of the Republic of Lithuania (Official Gazette, 2000, No. 75-2294).

Name of an administrative service

Information and consultation of persons on the issues of arrest, sentence enforcement and operational activities of Central Prison Hospital (hereinafter referred to as Hospital, institution), provision of information about a patient in compliance with the procedure established in legislation.

Description of an administrative service

Natural and legal entities who need information on enforcement of arrest and sentences, on operational activities of Hospital and other issues related to institution activities may apply for the service.

Requests/applications may be submitted orally (by telephone or upon personal arrival to the institution), in written (upon personal arrival to the institution), by post or via a courier.

Any information related personal health (status, diagnosis, prognosis, treatment, other personal information) is confidential.

Confidential information may be provided to other persons only upon written consent of a patient, which indicates basis for provision of such information and aims of using it, except in cases when a patient has confirmed by his/her signature and indicated in medical documents which person has the right to receive such information as well as the scope of provision and terms of such information.

The information about health of a person shall not be provided by telephone.

Oral requests/applications may be submitted in cases when a person is willing to receive oral information or get familiarized with a document without request for a document copy, when the information may be provided promptly without breach of the procedure established in laws or other legislation.

Information and other documentation to be submitted by a person

A person willing to receive information shall submit an application (or other form of request). He/she shall indicate in a request/application what information or documents he/she is willing to receive, name, surname, place of residence (provided a natural entity is applying) or name, code and registered office (provided a legal entity is applying) and contact details should also be indicated. Should a person’s representative apply for information, he/she should indicate his/her name, surname, place of residence as well as authorization for representation and name of a person on behalf of whom he/she is applying.

A person asking for private information on him/herself should indicate his/her personal code in a request/application and present a document proving personal identity. Should such request/application for information be sent by post or via a courier a notarized or otherwise validated in compliance with the procedure established in the legislation of the Republic of Lithuania copy of a document proving personal identity should be attached to it. Should a person‘s representative apply for such information he/she should provide an authorization for representation and a document proving personal identity.

All requests/applications submitted to Hospital in written should be signed by a person or his/her representative.

Should a request/application be submitted to Hospital by a person‘s representative whose authorization for representation is issued in another country, the above mentioned document should be legalized in compliance with the procedure established in Description of the Procedure for Document Legalization and Confirmation for Approval Certificate (Apostille) approved by the Resolution No. 1079 of 20 October 2006 of the Government of the Republic of Lithuania (Official Gazette, 2006, No. 118-4477);

State institutions and other agencies shall be provided information on a patient after submitting to Hospital the documents established in the Order No. 65 on Approval of the Procedure for Provision of Information about a Patient to State Institutions and Other Agencies of 1 February 2001 of the Minister of Health of the Republic of Lithuania (Official Gazette, 2001, No. 13-405).

Duration of provision of an administrative procedure

The information shall be provided promptly upon personal arrival to Hospital or by phone if no thorough examination is necessary.

Personal requests/applications should be examined within 20 working days from the day of its receipt in Hospital.

Hospital provides information on a patient which is within its possession to state institutions and other agencies not later than within 10 working days since the day of receipt of a request/application in compliance with the Order No. 65 of 1 February 2001 of the Minister of Health of the Republic of Lithuania.

The information is provided free of charge.

A request/application shall be submitted in free form. A request/application should be written in state language (this provision is not applied to requests/applications sent by post), written readably, signed by an applicant, indicating an applicant‘s information as set forth in Paragraph 4 on Information and other documentation to be submitted by a person.

An applicant may use the ready-made form of a request/application (.doc) or (.pdf), a filled-in request/application is recommended to be sent by post with attached documents.

Peculiarities of provision of an administrative procedure

In consideration of a person’s request/application information may be provided orally, a person may be allowed to get familiarized with a document, by issuing a reference certificate, duplicate, extract or paper copy of a document, electronic drives, audio, video or audio and video material, access to information file. Should the form for provision of information not be indicated in a request/application, it shall be provided in the same form as a submitted request/application.

Should consultations or provision of information require thorough examination a person shall be allowed to submit a request/application in written.
